Creditor Harassment Tips
Here are some key points for reducing creditor harrassment once
enrolled in our debt settlement program...
• Do not communicate with creditors.
When a creditor calls, redirect them to your attorney and keep a log of calls.
This information can be used during negotiation. Also forward any written
communication from creditors.
• Creditor intervention is the second major service that our attorneys provide, for
many clients this is well worth it. Cease and desists letters will be sent to all creditors which
highlights federal law on debt collection. It may take a few weeks before
all of the correct collectors are informed that you are being represented,
and to stop attempts to contact.
• There is no way to guarantee that the calls will stop all together. The FDCPA
only applies to collections agencies so original creditors could still call. We have found
however in our experience that once they know you are being represented by a
law firm they stop. If debt collectors do continue to harass you it will be more
leverage for our negotiation later and could constitute a lawsuit against the creditor.
• Throughout the debt settlement process we continue to communicate with the
creditors in a positive way and assure them that you are setting funds aside to pay
your debts.
